Major Intellectual Property Lawsuits in Vietnam and the Region

Researching famous intellectual property lawsuits and disputes in Vietnam provides a deeper understanding of the legal process and issues related to intellectual property protection. Some notable cases involving companies in the technology industry, copyright and patent disputes, or infringement of author’s rights in Vietnam and the region include:

  1. Lawsuit between Apple and Proview: In 2012, Apple was sued by Proview, a Chinese technology company, regarding the ownership rights of the “iPad” trademark. Proview claimed that they had registered the trademark beforehand and demanded that Apple cease using the name. The lawsuit concluded with both parties reaching a financial settlement.
  2. Lawsuit between Louis Vuitton and A.Q.A. Concept: In 2010, Louis Vuitton filed a lawsuit against A.Q.A. Concept in Vietnam for infringing their jewelry designs (Industrial Design). Louis Vuitton alleged that A.Q.A. Concept copied and produced jewelry products identical to their designs. The lawsuit ended with A.Q.A. Concept being forced to cease production and sale of the infringing intellectual property.
  3. Lawsuit between Honda and Bajaj: In 2016, Honda Motor Co., Ltd. initiated a lawsuit against Bajaj Auto Ltd. in Vietnam for infringing Honda’s intellectual property rights. Honda claimed that Bajaj copied the designs of some Honda motorcycles and produced similar models. The lawsuit concluded with Bajaj being required to cease production and sale of the infringing motorcycles.
  4. Lawsuit between Vinataba and Philip Morris: In 2011, Philip Morris International sued Vinataba, a company under the Ministry of Industry and Trade in Vietnam, for infringing their intellectual property rights related to the “Marlboro” brand. Philip Morris alleged that Vinataba copied the brand and sold tobacco products identical to their brand. The lawsuit ended with both parties reaching an out-of-court settlement.

These lawsuits are all related to intellectual property infringement and the protection of intellectual property rights in Vietnam. They highlight the importance of compliance and protection of intellectual property in business and industry activities in the country.
