Trademark registration through the Madrid Agreement (WIPO)

 

Trademark registration through the Madrid Agreement shall be carried out at WIPO (World intellectual property organization); it is a form of international trademark registration applied to states which are parties to the Madrid Agreement.

When registering the trademark through the Madrid Agreement, the holders shall be entitled to file their application in Vietnam, then, National Office of intellectual property of Vietnam shall file the application at WIPO, and at the same time appoint to contracting parties of the Madrid Agreement.

With this form of trademark registration, the holder shall enjoy the rule “first to file”, which means who fills a trademark registration application the first in a contracting party of the Madrid Agreement, shall have prior rights with that trademark when registering in any other contracting states of the Madrid Agreement.

Countries which are parties to the Madrid Agreement includes: Albania, Algeria, Armenia, Belgium, Bosnia and Herzegovina, Bulgaria, Vietnam, China, Croatia, German, Cuba, Italy, France,…The clients may contact with ASLAW to receive the full-detail list of contracting parties of the Madrid Agreement.

– The copy of certificate of registration for trademark; notarization and legalization are required.

– Power of Attorney (POA) executed by the applicant.
